1. Introduction

These Terms and Conditions ("Terms") govern your access to and use of the website archon.moe operated by ARCHON ("ARCHON," "we," "us" or "our"), together with any related features, content and services we make available (collectively, our "Services").

By accessing or using our Services, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree to these Terms, you may not use our Services.

ARCHON is a free, non-commercial fan project and is not affiliated with or endorsed by HoYoverse.

2. Eligibility

You must be at least 16 years of age to use our Services. By using our Services, you confirm that you meet this age requirement.

3. Your account

Some features of our Services require you to create an account, which you do by signing in with Discord or Google. You are responsible for all activity that occurs under your account. You agree not to share or transfer your account, and to let us know promptly if you become aware of any unauthorized use of it.

You may close your account at any time in Settings. We may suspend or terminate your account if we believe you have violated these Terms.

4. Importing your wish history

• You may only import wish history from game accounts that belong to you.
• The link from the game gives access to your wish history for a limited time. Keep it private and only paste it into our Services.
• We may remove data that was imported from a game account that does not belong to you.

5. License to use our Services

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use our Services for your personal, non-commercial use. This license does not include any right to:

• copy, modify, resell or otherwise commercially exploit our Services or their content;
• frame or mirror any part of our Services on another website or platform;
• use our Services or data from them to train, develop or improve any machine learning or artificial intelligence model without our prior written consent.

6. Intellectual property

Our Services, including their design, software, logos and other materials we make available, are owned by us and protected by copyright and other intellectual property laws.

Our Services include and reference content owned by third parties. Genshin Impact and all related names, images and other game content are the property of HoYoverse, and we make no claim of ownership over them. Other product and company names may be trademarks of their respective owners.

If you send us suggestions or other feedback about our Services, we may use it freely, without any obligation to you.

7. Acceptable use

You agree not to use our Services to:

• violate any applicable law or the rights of others;
• access other people's accounts or data;
• bypass or attempt to bypass any security measures, rate limits or other access restrictions;
• use automated means, such as bots, scrapers or scripts, to access our Services or copy data from them;
• interfere with, disrupt or overburden our Services or the servers that support them;
• create multiple accounts to get around limits or restrictions;
• impersonate any person or misrepresent your affiliation with anyone.

We may investigate any suspected violation of these Terms and take appropriate action, including limiting, suspending or terminating your account.

8. Third-party services

Our Services work with third-party services, such as Discord and Google for signing in and HoYoverse for your wish history, and may contain links to other websites. We are not responsible for the content, policies or practices of third-party services. Your use of them is governed by their own terms and privacy policies.

9. Disclaimers

Our Services are provided free of charge, "as is" and "as available." We do not guarantee that our Services will be uninterrupted or error-free. Statistics such as pity, 50/50 results and luck ratings are calculated by us for general information only and may be inaccurate.

We may change, suspend or discontinue any part of our Services at any time. If we plan to discontinue our Services, we will try to announce it in advance. Our Services are not designed as a backup service, so we recommend keeping your own copy of your wish history, which you can export in Settings.

10. Limitation of liability

We are liable without limitation for damage caused intentionally or through gross negligence, and for injury to life, body or health. For slight negligence, we are only liable for the breach of an essential obligation that makes the proper use of our Services possible, and only for the foreseeable damage typical of such a service. Otherwise, our liability is excluded. This does not affect liability that cannot be excluded by law.

11. Termination

You may stop using our Services and close your account at any time. We may suspend or terminate your access to our Services if you violate these Terms. When your account is closed, your data is deleted as described in our Privacy Policy.

12. Governing law

These Terms are governed by the laws of the Federal Republic of Germany. If you are a consumer living in the European Union, you also keep the protection of the mandatory laws of the country where you live.

13. Changes to these Terms

We may update these Terms from time to time. Updates take effect when they are published on this page, and we will revise the date at the top. If we make material changes, we will let you know in advance where possible.

14. General provisions

• Entire agreement. These Terms, together with our Privacy Policy, are the entire agreement between you and us regarding our Services.
• Severability. If any provision of these Terms is found to be invalid, the remaining provisions remain in full force and effect.
• No waiver. Our failure to enforce any provision of these Terms is not a waiver of our right to do so later.
• Language. The English version of these Terms controls. We may provide translations for convenience.
